These Terms of Use (“Terms of Use”) together with our affiliated services (outlined above), all set forth the entire terms and conditions applicable to each visitor or user (“User” or “you”) of Rattastic Discussions website (rattastic-discussions.co.uk and any of its subdomains, the “Website”), blog (Blog, Adventures, Rattastic Crafts, Information, and any of its subdomains, the “Blog”), magazine (“Magazine”, “Rattastic Discussions Magazine”), social media (Facebook, Instagram, Youtube and Pinterest, collectively “Social Media”), Rattastic Discussions Shop (“Shop”), and related services (collectively, the “Services”).

The Rattastic Discussions Terms constitute a binding and enforceable legal contract between Rattastic Discussions and its affiliated services (“Rattastic Discussions”, “we”, “our”, or “us”)  and you in relation to the use of any Rattastic Discussions services – so please read them carefully.

Who can use our website

In order to use our website and/or aforementioned services, you must be of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. 

Furthermore, you must be the age required in order to access Rattastic Discussions services on social media (YouTube, Facebook, Instagram and Pinterest) according to the Terms for the respective social media platforms.

To use Rattastic Discussions shop, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement.

You are not allowed to use this website and/or aforementioned services if doing so is prohibited in your country or under any law or regulation applicable to you. 

Key commercial terms offered to customers

When buying an item from Rattastic Discussions (at rattastic-discussions.co.uk and/or on any other platform Rattastic Discussions uses), you agree that:

  • You are responsible for reading the full item listing before making a commitment to buy
  • You enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the payment process

The prices we charge for our products are listed on the website (rattastic-discussions.co.uk), Facebook and Instagram. Rattastic Discussions reserves the right to change our prices for products displayed at any time, and to correct the pricing errors that may inadvertently occur. Additional information about pricing is available on our shop page.

Furthermore, Rattastic Discussions is not responsible for any extra charges that you may incur due to (but not limited to) the following:

  • International (non UK shipping)
  • Customs charges

Return and refund policy

For any undamaged product, simply return it with its included accessories and packaging, along with the original receipt within 14 days of the date you receive the product and we will offer a refund based upon the original payment method. In addition, please note the following:

  • Products can be returned only in the country in which they were originally purchased
  • The following products are not eligible for return
    • Items where the customer received the item and did not contact Rattastic Discussions within 14 days of the date they received the product 
    • Items where 28 days have elapsed from the date Rattastic Discussions shipped the item (UK only)
    • Items that have been used (i.e. a t-shirt was bought and then worn). Once an item has been used by a customer, it is no longer eligible for refund​​
  • The customer is responsible for the shipping cost incurred by returning the item
  • The customer is responsible for contacting Rattastic Discussions immediately upon receiving the item and deciding to return it so as not to miss the 14 day return window
  • The product will only be refunded once Rattastic Discussions receives the item, and within 14 days of Rattastic Discussions receiving the item

For damaged products, simply return it with its included accessories and packaging, along with the original receipt within 14 days of the date you receive the product and we will exchange it or offer a refund based upon the original payment method. In addition, please note the following:

  • The customer will be required to supply evidence that the item was delivered in a damaged condition
  • The customer is responsible for contacting Rattastic Discussions immediately upon receiving the damaged item and supplying Rattastic Discussions with photographic evidence that the item was delivered in a damaged condition, so as not to miss the 14 day return window
  • Products can be returned only in the country in which they were originally purchased
  • Any item found to be damaged after 28 days have elapsed from the date Rattastic Discussions shipped the item (UK only) may or may not be refunded at Rattastic Discussions’ discretion
  • The customer is responsible for the shipping cost incurred by returning the item (this cost will however be added to the customer’s refund upon Rattastic Discussions receiving the damaged product)
  • The product will only be refunded once Rattastic Discussions receives the item

Retention of the right to change offering

Rattastic Discussions may, without prior notice:

  • Change the services 
  • Stop providing the services, or any feature of the services
  • Create limits for the services

Rattastic Discussions may permanently, or temporarily, terminate or suspend access to any of the services without ​prior notice or liability for any reason, or no reason.

Ownership of intellectual property, copyrights and logos

The Service and all materials therein or transferred thereby, including, without limitation, images, text, logos, graphics, copyrights, trademarks, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Rattastic Discussions. Except as explicitly stated herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

You recognise and agree that by uploading any content (including, but not limited to photos, stories, artwork, designs, images, animations, videos, audio files, articles, fonts, logos, illustrations) through any means to our website (rattastic-discussions.co.uk), email ([email protected]), or by any of our social media pages, you confirm that you own all relevant rights or received the appropriate license to upload/transfer/send the content. Furthermore, you agree and consent that the uploaded/transferred content may be publicly displayed in the following ways:

  • On the website (rattastic-discussions.co.uk)
  • On the blog
  • In the magazine
  • On any (or all) of Rattastic Discussions’ social media pages
  • In any other way Rattastic Discussions deems appropriate

Right to suspend or cancel user account

Rattastic Discussions may permanently or temporarily terminate or suspend your access to the service without prior notice and liability for any reason, including if in our sole determination, you violate any provision of these Terms or any applicable laws or regulations.

Indemnification 

You agree to indemnify and hold Rattastic Discussions harmless from any demands, loss, liability, claims or expenses (including attorney’s fees), made against them by any third party due to, or arising out of, or in connection with your use of the website (rattastic-discussions.co.uk) or any of Rattastic Discussions affiliated services.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Rattastic Discussions be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of products, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Rattastic Discussions assumes no liability or responsibility for any of the following:

  • Mistakes, errors, or inaccuracies of content
  • Personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service
  • Any unauthorised access to or use of our secure servers and/or any and all personal information stored within

Right to change and modify terms

Rattastic Discussions reserves the right to modify these terms from time to time at our sole discretion. Therefore, it is your responsibility to review these pages often to ensure that you still agree to be bound to these Terms. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of Rattastic Discussions website (rattastic-discussions.co.uk) and all other Rattastic Discussions affiliated services, after any such change constitutes your acceptance of the new Terms.

If you do not agree with any of these Terms, or any future versions of the Terms, do not use or access (or continue to access) Rattastic Discussions website (rattastic-discussions.co.uk) and/or all other Rattastic Discussions affiliated services.

By using the website (rattastic-discussions.co.uk) and/or all other Rattastic Discussions affiliated services you agree to receive promotional messages and materials from us by email, or any other contact method you may provide us with.

If you don’t want to receive such promotional materials or notices, please just notify us at any time.

Please note that by joining our community, users will have a public profile that is public to site visitors, and their public activity (such as posts and comments) will be publicly visible on the website.

Preference of law and dispute resolution

These Terms, and the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the UK, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in the UK.
